Public Information Requests
The City of Merkel, Merkel Police Department is required under certain provisions in the Texas Public Information Act to provide records in response to a request.
MAKING A REQUEST
The request must ask for records or information already in existence. The Public Information Act does not require a governmental body to create new information, to do legal research, or to answer questions.

RESPONSE TO REQUEST
The department has up to ten (10) business days in which to respond to your request, pursuant to the Public Information Act, but will make every effort to process your request as soon as possible following receipt of your request.

Many times records that are maintained by a law enforcement agency are not public record or require review by the Texas Attorney General's Office prior to the records being released. In all cases the agency is required to provide a response to the request within (10) ten days.
The Merkel Police Department receives records requests from a number of different entities for various reasons. Prior to making a formal request, please read the criteria outlined below to ensure that the records that you are requesting are available for public release.

Who is the custodian of police records for the City of Merkel?
The Chief of Police oversees requests for public information and Open Records Requests for the Merkel Police Department ONLY. This does not include Human Resources or Personnel Records for City Employees. How do I know if I can get a copy of a Police Record before I make a request?
There are a number of variables that relate to the release of Police Records. The Merkel Police Department cannot determine PRIOR to recieving a request whether or not that request will be fulfilled. To be put simply, if the record is not protected by a known law protecting the record, the only options for the department is to send it to the Attorney Generals Office for an "AG" Opinion or Release the Record. Either way we will respond to your request within (10) ten business days advising of the outcome of the request.

My boy/girl friend was arrested over the weekend, can I see the Police Report?
No. There are some elements of the arrest that are immediately public record. However the investigative report that is produced by this agency is not an open record until the case is diposed by the courts. (Ref. TEX GOV CODE Sec. 552.108)
